False accusation, rights violation: About a month ago, Eric Berg & Associates represented a man accused of a felony for giving two pounds of pot butter to a friend. The authorities lied in the police report and claimed that the man accused had confessed to the crime. Mr. Berg demanded an actual copy of the tape recording of his clients statements. When Mr. Berg finally got that tape recording, it showed that the officer lied in his report about the confession. The tape also showed that the officer never read the accused his miranda rights and interviewed him even after he had demanded an attorney. For these reasons, Mr. Berg filed a motion to suppress the evidence against his client and the prosecutor promptly dismissed the case.
