Under new California laws including the Medical Marijuana Regulation and Safety Act, certain felons will have a harder time applying for the new licenses or getting employed at licensed marijuana businesses.

The licensing authority may deny the application for licensure or renewal of a state license if any of the following conditions apply:

  • A felony conviction for the illegal possession for sale, sale, manufacture, transportation, or cultivation of a controlled substance (including marijuana.)
  • A felony conviction involving fraud, deceit, or embezzlement.
  • A felony conviction meeting certain criteria regarding violence or seriousness.

At Berg and Associates, we have often been able to help a client get a felony conviction erased and expunged from their criminal record. This has included crimes of violence, including spousal abuse. We have assisted many clients receive Certifications of Rehabilitation, a California court‑order declaring that a person previously convicted of a felony is now rehabilitated. This allows the restoration of civil and political rights of citizenship to ex‑felons who have proved their rehabilitation.
